Terms and Conditions

Please read these Terms and Conditions carefully before using braintain.app or the Braintain mobile application. These Terms constitute a legally binding agreement between you and Braintain.

1. Acceptance of Terms

By downloading, installing, or using the Braintain application or website (collectively, the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service.

2. Description of the Service

Braintain is a spaced-repetition learning app that helps users memorise concepts through AI-assisted flashcards, visual anchors, and an adaptive review schedule. Features include BrainPods (topic-based card decks), a challenge mode, study streaks, and an AI Coach available to Premium subscribers.

3. Eligibility

You must be at least 13 years old to use Braintain (16 in the European Economic Area). By using the Service you confirm that you meet this requirement. Parents or guardians are responsible for supervising use by minors.

4. Account Registration

You must provide a valid email address and keep your account credentials confidential.
You are responsible for all activity that occurs under your account.
You must notify us immediately at support@braintain.app if you suspect unauthorised access.
We reserve the right to suspend or terminate accounts that violate these Terms.

5. Premium Subscription

Billing

Braintain Premium is available as a monthly or annual auto-renewing subscription purchased through the Apple App Store or Google Play. Your subscription renews automatically unless cancelled at least 24 hours before the end of the current period.

Cancellation

You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period — you retain Premium access until then.

Refunds

Refund requests are handled by Apple or Google according to their respective refund policies. Braintain does not process refunds directly.

Price changes

We may change subscription prices with reasonable advance notice. Continued use after the price change takes effect constitutes acceptance.

6. User-Generated Content

You may create custom flashcard decks within the Service. By doing so you grant Braintain a non-exclusive, royalty-free licence to store and display that content solely to provide the Service to you. You retain ownership of your content. You must not upload content that is illegal, infringing, defamatory, or otherwise harmful.

7. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to reverse-engineer, decompile, or tamper with the app
Scrape, crawl, or systematically extract data from the Service
Impersonate another person or entity
Interfere with or disrupt the Service or its servers
Use the Service to distribute spam or malware

8. Intellectual Property

All content, design, logos, and software in the Service (excluding user-generated content) are the property of Braintain or its licensors and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

9. Third-Party Services

The Service integrates with third-party platforms including Firebase (Google), Google AdMob, RevenueCat, and Apple / Google app stores. These services are governed by their own terms and privacy policies. Braintain is not responsible for the practices of third-party services.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that learning outcomes will meet your expectations.

11. Limitation of Liability

To the fullest extent permitted by law, Braintain shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms, or for any other reason with reasonable notice. Upon termination you lose access to the Service; provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) shall survive.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the effective date above and, where appropriate, via in-app notification. Your continued use of the Service after the updated Terms take effect constitutes your acceptance.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Spain.
